SMDP Open Enrolment Terms

1. The parties

These terms are between Growth Matters South Africa (Pty) Ltd, registration number 2011/011131/07, VAT number 4910267519 ("GMSA", "we"), and the person enrolling ("you"). If your company pays, the person attending remains the participant, and your company is responsible for payment.

2. The program

SMDP Open 2027 is a 12-month sales management program delivered live and virtually. It includes an onboarding session and an introduction session in January 2027, nine instructor-led Episodes of three hours across three Seasons, three syndicate coaching sessions, a private pre- and post-program assessment, and graduation in November 2027. The dates for each class are published on www.thesmdp.com and form part of these terms.

3. Classes

  1. There are three classes: Americas (Tuesdays, US Eastern Time), Africa, Middle East and Europe (Wednesdays, South African time) and Asia Pacific (Thursdays, Singapore time).
  2. Each class needs at least 12 paid participants to run and takes no more than 24.
  3. We confirm on 15 January 2027 whether your class will run. If it will not, you may move to another class or receive a full refund.
  4. We may change a facilitator or a date for reasons outside our control. We will tell you as early as we can, and if the change does not suit you, clause 7 applies as if you had cancelled before the refund deadline.

3.5 Facilitators and commission. Facilitators who share their own link to www.thesmdp.com earn a commission from GMSA of 5% of the price paid, excluding taxes, on seats reserved through that link. The commission never changes the price you pay, and it does not affect how your class is run or assessed.

4. Prices and discounts

  1. South African prices exclude VAT at 15%, which is added to your invoice. Customers outside South Africa are invoiced in US dollars, and these supplies are zero-rated for South African VAT.
  2. Discounts do not combine. You pay the lowest single price you qualify for.
  3. Early-bird dates refer to the date you reserve, provided you pay within the 7-day hold.
  4. The referral and graduate prices apply only once we have verified the details you give us. If we cannot verify them within 2 business days, we invoice the price you would otherwise qualify for and tell you why. By claiming a referral price, you confirm that the graduate you name agreed to you sharing their name, email and mobile number with us, and to us contacting them once to confirm the referral.

5. Reserving and paying

  1. Reserving holds your seat for 7 days. We email a pro-forma invoice to you. If your company is paying, forward it to your finance team.
  2. You pay by EFT using the reference on the pro-forma invoice. Your seat is confirmed when the payment reaches our account, and we then issue a tax invoice.
  3. If payment has not arrived by the end of the hold, the seat is released and the reservation lapses. You may reserve again if seats remain, at the price applying on that date.
  4. You are responsible for bank charges on your side of the transfer.

6. Enrolment closes

Enrolment closes on 15 January 2027, or earlier if your class is full.

7. Cancellation and refunds

  1. You may cancel for a full refund until 22 January 2027, or within 7 days of paying, whichever is later.
  2. After that, no refund is due, but you may transfer your seat to a colleague or to the next intake at no charge by telling us in writing.
  3. Refunds are paid to the account the payment came from, within 14 days.

8. Attendance

  1. Dates are published in advance and sessions are not recorded for catch-up.
  2. If you cannot attend an Episode for a reason we accept as valid, you may attend the same Episode in another region's class, where there is space.
  3. You need a stable internet connection and a device with camera and microphone.

9. Assessment

Your pre- and post-program assessment results are private to you and your facilitator. We share them with your employer only if you agree.

10. Intellectual property

All program materials remain the property of Growth Matters International and its licensors. You may use them for your own development and in managing your own team. You may not copy, share, record or resell them, or use them to train others.

11. Liability

We will deliver the program with reasonable skill and care. To the extent the law allows, our total liability to you is limited to the fees you paid. We are not liable for indirect or consequential loss, including lost sales or profits. Nothing in these terms limits rights you have under consumer protection law that cannot be excluded.

12. Circumstances beyond our control

If events outside our reasonable control prevent a session from running, we will reschedule it and tell you as soon as possible.

13. Personal information

We handle your personal information as set out in our Privacy Policy at www.thesmdp.com/privacy.

14. Law and disputes

  1. These terms are governed by the law of South Africa.
  2. If a dispute arises, either of us may give the other written notice of it, and we will both try to settle it by discussion within 20 business days.
  3. If that fails, the dispute goes to mediation before a single mediator we agree on. If we cannot agree on one within 10 business days, either of us may ask the Arbitration Foundation of Southern Africa to appoint one. Mediation is held online by video unless we both agree otherwise, in English, and each of us pays half the mediator's fees.
  4. Either of us may go to court only if mediation has not resolved the dispute within 30 business days of the mediator's appointment. The High Court of South Africa, Gauteng Division, Johannesburg has jurisdiction.
  5. Nothing in this clause stops either of us seeking urgent interim relief from a court, or stops you from approaching an ombud or regulator you are entitled to use.
